These terms apply when you browse or place an order through the Mitre 10 Ferrymead Landscape Supplies Christchurch website.

Landscape Supplies Christchurch is operated by AEC HARDWARE LIMITED, trading as Mitre 10 Ferrymead Landscape Supplies.

By placing an order, you agree to these terms. Nothing in these terms limits any rights you have under the Consumer Guarantees Act 1993, Fair Trading Act 1986 or other applicable New Zealand law.

1. About our online store

We sell landscape products and related collection services for customers in Christchurch and selected areas of Canterbury.

We are a New Zealand business operating in trade. Products and services purchased through this website are covered by applicable New Zealand consumer law. Products must be of acceptable quality, match their description and be fit for any purpose you make known to us.

2. Product information

We take reasonable care to ensure product descriptions, images, measurements and prices are accurate.

Landscape materials are natural products. Their colour, texture, moisture content, particle size and appearance may vary between batches. Images are representative and may not show the exact product supplied.

Sizes such as chip, pebble, bark and aggregate measurements are approximate grading ranges. Individual pieces may fall slightly outside the stated range.

Coverage estimates and calculator results are guides only. The quantity required may vary depending on compaction, settlement, ground conditions, installation depth and wastage.

3. Product availability

All products are subject to availability.

Adding a product to your cart does not reserve it. If a product becomes unavailable after you order, we will contact you to arrange one of the following:

  • a suitable alternative
  • a revised collection or delivery date
  • a refund for the unavailable product

We may limit quantities where stock is restricted or where an order cannot be safely transported or delivered.

4. Prices and payment

All prices are in New Zealand dollars and include GST unless stated otherwise.

Delivery charges and any other applicable fees will be shown before you complete checkout.

Payment must be completed using one of the payment methods available at checkout. Your order is not confirmed until payment has been accepted and you receive an order confirmation.

If a pricing or website error is identified before fulfilment, we will contact you. You may choose to pay the correct price or cancel the affected item for a refund.

We will not charge a higher price or substitute a product without your agreement.

5. Order acceptance

Your checkout submission is an offer to purchase from us.

An automated order confirmation acknowledges that we have received your order. It does not necessarily mean that the order has been accepted or is ready for collection or delivery.

We may decline or cancel an order where:

  • the product is unavailable
  • the price or product information contains a clear error
  • we cannot safely fulfil or deliver the order
  • payment is unsuccessful or suspected to be unauthorised
  • the order breaches these terms or applicable law

If we cancel an order after payment, we will refund the affected amount using the original payment method.

Electronic orders and communications can have legal effect under New Zealand’s electronic transactions rules.

Wait until you receive confirmation that your order is ready before travelling to collect it.

When collecting, you may need to provide:

  • your order confirmation
  • the name used for the order
  • photo identification
  • details of any person collecting on your behalf

You are responsible for bringing a vehicle or trailer that can safely carry the order.

Our team may refuse to load a vehicle or trailer where they reasonably believe:

  • the load would exceed its safe or legal capacity
  • the load cannot be adequately secured
  • the vehicle or trailer is unsuitable
  • loading would create a safety risk

You remain responsible for securing and transporting the load after it leaves our premises.

7. Delivery

Delivery is available to selected Christchurch and Canterbury addresses.

Available delivery options, charges and estimated timeframes will be shown at checkout or confirmed with you after ordering.

Delivery timeframes are estimates. We will take reasonable care to deliver within the agreed or a reasonable timeframe. Weather, traffic, access restrictions, product availability and other circumstances outside our reasonable control may cause delays.

The person placing the order must provide accurate delivery instructions and tell us about any access issues, including:

  • narrow or shared driveways
  • low branches or overhead wires
  • steep, soft or uneven ground
  • restricted turning space
  • gates, fences or parked vehicles
  • underground services or fragile surfaces
  • any other hazard that could affect delivery

The driver will decide where the product can be safely unloaded. Delivery is generally made to an accessible point on the property and does not guarantee placement in a specific garden, rear section or work area.

We may refuse or adjust delivery where access is unsafe or unsuitable. Additional delivery costs may apply if information supplied by the customer is incomplete or inaccurate, but these will be discussed before being charged.

Risk in the products passes to you once they have been safely delivered or collected.

8. Missed or unsuccessful delivery

Someone may need to be present to receive the order where advised.

If delivery cannot be completed because access is unavailable, unsafe or materially different from the information provided, we may:

  • return the order to the store
  • arrange another delivery
  • charge a reasonable redelivery fee

We will contact you before arranging any additional paid delivery.

9. Cancellations and changes

Contact us as soon as possible if you need to change or cancel an order.

We may be able to cancel or amend an order before it has been prepared, loaded or dispatched. Once fulfilment has started, cancellation may not be possible.

Any cancellation fee must reflect reasonable costs already incurred. We will explain any applicable cost before processing the cancellation.

A change-of-mind return is not automatically required under the Consumer Guarantees Act. However, we may accept eligible returns under our store returns policy.

10. Returns and refunds

Contact us promptly if a product is faulty, damaged, materially different from its description or unsuitable for a purpose you clearly discussed with us before purchase.

Where the Consumer Guarantees Act applies, you may be entitled to a repair, replacement or refund depending on the issue. Nothing in these terms limits those rights.

Because loose landscape materials can be mixed, contaminated or altered after delivery, we may be unable to accept change-of-mind returns once they have been:

  • tipped or unloaded
  • mixed with another material
  • spread or installed
  • exposed to contamination
  • removed from their original sealed packaging

Bagged products considered for a change-of-mind return must generally be unopened, unused and in resalable condition. Contact us before returning anything.

Delivery charges are not normally refundable for a change-of-mind return.

11. Free trailer hire

Complimentary trailer hire may be available for up to 2 hours when collecting suitable products from Mitre 10 Ferrymead.

Select trailer hire with your order where available, then see the team in the Mitre 10 Drive-Thru building when you arrive.

Trailer hire is:

  • subject to availability and store approval
  • limited to the agreed hire period
  • available only for a suitable and legally compliant towing vehicle
  • subject to the store’s identification, licence and hire requirements
  • subject to any separate trailer-hire agreement presented at collection

The driver must hold the correct current driver licence and is responsible for confirming that their vehicle can legally and safely tow the trailer and load.

The trailer must be returned on time and in substantially the same condition as when collected, allowing for reasonable wear.

You must immediately contact the store if the trailer is damaged, involved in an incident, lost, stolen or cannot be returned on time.

Additional charges may apply for late return, damage, loss, cleaning or other costs where permitted by the separate hire agreement and applicable law.

12. Safety and intended use

You are responsible for checking that the product is suitable for your project.

Seek professional advice where a project involves:

  • structural retaining
  • vehicle-bearing surfaces
  • drainage design
  • concrete strength
  • underground services
  • building or resource consent requirements
  • electrical or plumbing work

Product descriptions and calculators provide general guidance and are not a substitute for project-specific engineering or trade advice.

13. Website use

You may use this website for lawful personal or business purchasing purposes.

You must not:

  • interfere with the website or its security
  • attempt unauthorised access
  • use automated systems in a way that affects site operation
  • copy or commercially reuse website content without permission
  • provide false or misleading order information

14. Third-party services

Our website may use services provided by Shopify, payment providers, delivery partners, analytics providers and other technology suppliers.

Those services may have their own terms and privacy practices. We are not responsible for third-party websites that you visit through an external link.

15. Liability

Nothing in these terms excludes or restricts liability where doing so would be unlawful, including your rights under the Consumer Guarantees Act and Fair Trading Act.

To the extent permitted by law, we are not responsible for loss caused by:

  • incorrect measurements or quantities supplied by the customer
  • using a product for an unsuitable or undisclosed purpose
  • improper installation, storage or handling
  • natural variation in landscape materials
  • delays outside our reasonable control
  • unsafe or unsuitable site access
  • failure to follow applicable product or project instructions

The Fair Trading Act prohibits misleading conduct and also regulates unfair standard-form consumer contract terms. Terms cannot override those statutory protections.

16. Business purchases

Where goods are acquired in trade for business purposes, the parties may agree in writing that the Consumer Guarantees Act does not apply, but only where contracting out is fair and reasonable and legally permitted.

No contracting out applies automatically merely because an order uses a business name.

17. Changes to these terms

We may update these terms when our services, systems or legal obligations change.

The terms displayed when you place your order will apply to that order. Changes will not retrospectively alter an existing confirmed order unless required by law or agreed with you.

18. Governing law

These terms are governed by New Zealand law.

Any dispute will be handled by the New Zealand courts or tribunals with jurisdiction.
